PARTIES

Please read these Terms and Conditions (“terms”) carefully before using the My Resume Rocks website or any of our services. Any reference to ("us", "we", "our", “our site”, “service”, “staff”, “employee”, “MRR”) refers to Ernie Rodrigues dba My Resume Rocks (“www.myresume.rocks”). Your use of our services is conditioned upon your acceptance of and compliance with these terms. These terms apply to all visitors, customers, users, subscribers, and others who wish to access or use any of our services. By accessing or using any of our services you agree to be bound by these terms. If you disagree with any part of these terms then you do not have permission to access or use our services. This Agreement contains the entire agreement of the parties (“You”, “subscriber”, “member”, “your”, “customer” means you individually and “My Resume Rocks”) and there are no other promises or conditions in any other agreement whether oral or written concerning the subject matter of this Agreement. This Agreement supersedes any prior written or oral agreements between the parties.

By requesting our services you are representing that you are over the age of 18 and have the capacity and authority to bind yourself to our terms and conditions. When you initiate a service request with us, you not only guarantee that you are above the age of 18, and that the information you provide to us is accurate, complete, and free of errors. Use of our service is entirely at the customer's risk. The customer agrees it shall defend, indemnify, save and hold us harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against us, its agents, third-parties, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by us.

SEVERABILITY

The failure of My Resume Rocks to exercise or enforce any right or provision of the terms shall not constitute a waiver of such right or provision. You agree that the terms of this agreement are severable. If any part of this agreement is determined to be unenforceable or invalid, that part of the agreement will be interpreted in accordance with applicable law as closely as possible, in line with the original intention of both parties to the agreement. The remaining terms and conditions will remain in full force and effect.

JURISDICTION

Parties agree that any disputes related to this agreement shall be governed in all respects by and construed in accordance with the laws of the USA, state of California, county of Marin. Some states or territories may not allow such a broad exclusion or limitation on liability for damages as contained herein. In such states or territories you agree that in no event shall My Resume Rock’s maximum liability exceed the total amount paid by you for the particular product or service in dispute purchased from My Resume Rock.

DOMAIN LEASING

MRR offers domain name leasing for active subscribers at no additional charge. This service is offered to our customers as a courtesy to personalize their online resume. This lease is only offered while a users account is active. Cancelation or deactivation of your account for any reason will result in your lease being terminated. Domain lease termination will result in your leased web addresses (domain name) not being accessible to you and the general public, including but not limited to potential recruiters and hiring managers. During the sign up process you will be asked to provide 3 domain names of your choice. We will attempt to register one of the provided domain names in the order provided. MRR unfortunately is unable to guarantee availability of any domain name. If none of your chosen domain names are available you may receive a call or email requesting additional information to complete the domain registration process. In rare circumstances with MRR approval and at the customers request you may use a myresume.rocks sub directory to access your online resume (“www.myresume.rocks/yourname”). We suggest that subscriber remain responsive to our contact attempts to ensure rapid resolution of any domain registration issues. Due to domain name propagation (world wide server record updates) requirements your site may take up to 72 hours to be available. This is typically worst case scenario. Subscriber releases MRR and third party domain registrar from any liability due to delays in domain name accessibility during initial registration and setup process.Upon cancellation subscriber may request to have their leased domain name ownership transferred to them. Please note that the ownership transfer of any domain name is not guaranteed. Any domain transfer consideration or approval is at the sole discretion of MRR. User is responsible for maintaining all fees associated with keeping their subscription active.  Any deactivation due to non payment or breach of terms will result in subscribers leased domain name no longer being accessible to subscriber and the general public (including but not limited to potential recruiters and hiring managers).

CONTENT PUBLISHING

Upon initiating a subscription request with us, you are expected to ensure that all information on your resume is free of errors. Resumes should not only be error free but consist of current information. MRR cannot be held responsible for the correctness, completeness, or quality of the information provided by subscribers. Therefore, liability claims regarding any damages caused by the use of any information provided, including information which is incomplete or incorrect, will be discarded. By submitting your resume you authorize MRR to publish any information provided on your uploaded resume, via email, or provided to our staff verbally. Information including but not limited to (Name, phone number, email address, physical address, work experience, education, hobbies and interests). It is the customers responsibility to review their resume after being notified of completion, and to notify our staff of any issues. We strive to keep our monthly fees at the most affordable rate possible. However, at the discretion of MRR staff any modifications required after completion notification, due to customer error may result in a change fee.MRR takes information privacy seriously. MRR reserve the right to exclude or modify any information at our discretion during the resume build process for any reason that we see fit. Reasons such as but not limited to sections of your resume being added to your online resume to match your submitted resume format, section name changes, spelling corrections, etc.We reserve the right to omit third party personal information from your online resume for privacy purposes.User is responsible for spell checking and ensuring that all information provided in uploaded resume is free of errors. Although we attempt to catch issues with uploaded resumes we cannot be held responsible.  You are exclusively responsible for the content that you submit, including any violation and defiance of any law(s) contained within such submissions, copyright, fraud, privacy, and other regulations and laws. You fully agree to hold us harmless and defend us and indemnify us from any civil actions filed or threatened to be filed by any third party or entity who establishes that your submitted content support a legal cause of action. We also reserve the right to publish the contents of emails that you send us. Examples would be letters of praise, testimonials, thank you notes and so forth.

COMPLETION NOTIFICATION

Upon completion of your resume build and domain registration you will be sent an email to notifying you that your resume is complete and accessible. Within this email we will include your web address. MRR cannot guarantee the delivery of any email sent via the web. Therefore, if you do not receive a notification of completion within 5 days of sign up please email our support group at support@myresume.rocks to notify our staff.

FINISHED PRODUCT

Please note that all efforts are made to produce quality designs as shown in our gallery of work. We test all finished designs on multiple devices and within multiple browsers (utilizing various resolutions settings). However, on rare occurrences factors may alter the look and feel of your finished resume design. Factors including but not limited to: - Lengthy sections of text- Device resolution setting- Monitor color settings- Browser rendering

RESULTS DISCLAIMER

MRR provides high quality online resumes designs and hosting services as an enhanced tool to assist you during your job search. We under no circumstance guarantee employment or any particular results due the use of our services. MRR does not guarantee employment nor additional employment opportunities. MRR does not market individual resumes. It is your sole responsibility to market your online resume to increase visibility. DATA RETENTION POLICY

Due to high demand and volume of subscribers we are unable to retain all data and files submitted by subscribers during the sign up process. MRR reserves the right to discard of submitted data at our discretion, including but not limited to uploaded resume, personal data, and photos.THIRD PARTY HOSTING My Resume Rocks does not own or maintain our own servers. MRR uses high-performance shared hosting by reputable hosting providers.  At the current state of technology, it is impossible to guarantee that data communication via the Internet or wireless will be completely safe, free of faults and/or available at all times. Even though hosting companies strive to keep downtime to a minimum, downtime may occur. MRR therefore does not guarantee the availability of its service or subscribers online resumes at all times and shall not be liable for disappointed trust of the user in its faultless functioning. MRR is not liable for any failure or delay caused by problems with Internet connections. By using our service you agree to release from liability any entity, provider, or merchant utilized by MRR as a tool to provide you with service. Please notify us if you discover that your resume is not available, at support@myresume.rocksSubscriber agrees to take full responsibility for files and data uploaded and to maintain an appropriate offsite backup of files and data that you have submitted for the creation of your online resume. We including third party hosting vendor are not liable for any data loss due to server failure, unforeseeable corruption of programs, hacking, or any other failure whatsoever.

CONTENT COPYRIGHT

All resume designs including but not limited to HTML, CSS, JPG, and PNG files are the sole property of MRR. All web addresses (domain names) and web designs created for you are only accessible to you and the general public while your account is active. All content provided within this site and within leased hosting space is the sole property of My Resume Rocks and is fully protected by various US and international patent laws, copyright laws, trademark regulations and laws, and various intellectual property laws and international agreements and treaties. No intellectual property of any nature contained within or via this site may be published, copied, or broadcast in any way without the written permission of My Resume Rocks. In addition, the look and feel of the Site (including all page headers, page designs, resume designs, custom graphics, scripts, or any other material created) is the service mark, trademark, and/or trade dress of My Resume Rocks and may not be copied, imitated, or used (in whole or in part) without My Resume Rock’s prior written permission. The use of any third party trademarks, logos, or brand names is for informational purposes only, and does not imply an endorsement by My Resume Rocks or vice-versa or that such trademark owner has authorized My Resume Rocks to promote its products or services.

THIRD PARTY BILLING

You hereby authorize MRR’s third-party service to charge and/or place a hold on your credit card with respect to your monthly subscription fee, and/or any other requested service. You authorize the issuer of the credit card to pay any amounts agreed upon during your subscription purchase request without requiring a signed receipt, and you agree that these charges are to be accepted as authorization to the issuer of the card to pay any amounts without requiring a signed receipt, and you agree that these charges are to be accepted as authorization to the issuer of the credit card to pay all such amounts. You authorize MRR and/or any other company who bills products or services, or acts as billing agent for MRR to continue to attempt to charge and/or place holds with respect to all sums described herein, or any portion thereof, to your credit card until such amounts are paid in full. If you provide a debit card number, instead of a credit card number, you authorize all charges described herein to be applied to such debit card. When payment is made by credit card or debit card, payment will also be subject to the terms and conditions established by the credit or debit card issuer. Credit card data is not stored by MRR, but collected and processed through our website by a third-party vendor.It’s the subscribers responsibility to have adequate funds available in their credit or debit card account to cover fees, and to ensure account is active and valid.  Insufficient funds and/or overdraft fees are not the responsibility of my resume rocks.  User is responsible for updating their billing information as needed to ensure that deactivation of their hosted resume and domain lease does not occur. To reactivate a resume or domain lease user may need to place a new order. 

CANCELLATION POLICY

You may cancel your subscription at anytime for any reason. To cancel your subscription please submit a cancellation request by emailing to support@myresume.rocks. Please include your name and resume domain name. Account cancellation requests must come from the email account that you used during the subscription process, and must be received 5 days prior to your next billing cycle. Please allow up to 48 hours for email confirmation. If you do not receive an email cancellation confirmation within 48 hours please notify our staff at support@myresume.rocks MRR is not responsible for recurring billing charges due to subscriber not canceling service or cancellation email not being received. If the month that you decide to cancel your subscription is already paid for, you will not be entitled to compensation for the remainder of the given month. We do not prorate. * Please note that cancellation of your hosting account also cancels your domain lease. An ‘order/subscription request’ is deemed to be a written contract between MRR and the subscriber, this includes email agreements. If any payment due from you to us is not received by the due date as determined by third party billing vendor, at the discretion of MRR your account may be cancelled.

REFUND POLICY

Excluding exceptional circumstances, no refunds will be issued. If MRR is proven to be at fault, refunds will be considered but cannot be guaranteed.

PRICE CHANGE

Although we strive to offer great quality products and service at an affordable rate, on occasion we may need to increase costs to maintain overhead. We reserve the right to change subscription fees of current subscribers without prior notification.ACCEPTABLE USE POLICYIt is your responsibility at all times to:- Use our products and services in a manner which does not violate any applicable laws or regulations- Respect the legal protection afforded by copyright, trademarks, license rights and other laws to materials accessible via our service.

ACCOUNT TERMINATION

My Resume Rocks in our sole discretion reserves the right to refuse, terminate, conclude, or cancel your subscription or domain name lease at any time without notice for any reason that we consider fit. MRR will not refund subscribers whose account has been terminated.Your subscription and domain lease may be terminated for the following reasons including but not limited to:- Protect the stability of our services- Comply with applicable laws, government rules or requests of law enforcement- Comply with our upstream service providers- Deceptive, improper or misleading conduct- Providing false information- Harassment, abuse or swearing- Unlawful activities- Conduct that breaches this agreement- There is evidence of fraudulent, illegal, defamatory, offensive activities, or any activity in breach of a third party’s rights- We deem any other reason as satisfactory to protect My Resume Rocks, our staff, affiliates, employees, or any of our third party service providers.

TERMS UPDATE

These Terms and Conditions are subject to change without prior notification. Any changes will be published to www.myresume.rocks/terms-and-conditions.html. By continuing to use our service you agree to all modifications of terms once posted.
